Terms of Service

Effective date: 2026-08-11 · Last updated: 2026-08-11

1. Agreement

These Terms govern use of the ArterialPulse portal at pulse.rhythmtraffic.com and the ArterialPulse mobile applications (together, the Service), provided by Rhythm Engineering (“we”, “us”). By creating an account, or by using the Service on behalf of an organization, you agree to these Terms.

ArterialPulse is a business-to-business tool for transportation engineers and consultants. It is not offered to consumers, and it is not a navigation product. If you are accepting on behalf of an organization, you represent that you are authorized to bind that organization.

2. Accounts and organizations

  • All data is scoped to an organization. Each user belongs to exactly one organization and holds one role: org admin, engineer, or viewer. Org admins manage users, seats, and billing.
  • Accounts are individual. Credentials must not be shared; signing in invalidates any other active session for that account.
  • You are responsible for activity under your account and for keeping your credentials secure. Tell us promptly at [email protected] if you believe an account has been compromised.
  • A verified email address is required. We may suspend accounts used to abuse, probe, or overload the Service.

3. Trials

New organizations receive a 30-day free trial with the full feature set and no payment method required. Exports generated during a trial are watermarked (“Unlicensed copy. Use for demo only”) and are not intended for delivery to a client or agency.

When a trial ends without a purchase, portal access is suspended. Your data is retained and becomes available again on purchase — see §7.

4. Licenses, fees, and renewal

The Service is licensed per seat. Current pricing:

  • $3,500 per seat, one-time license fee.
  • $1,000 per seat per year for support, hosting, and updates. The first year is billed at purchase — so a single seat is $4,500 due at checkout, then $1,000 per seat per year thereafter.

Each license renews on its own date. Licenses purchased together share an anniversary; licenses purchased later get their own annual renewal dated twelve months from that purchase. Annual support renews automatically unless cancelled.

Cancellation. An org admin may cancel any license at any time. Cancellation stops that license’s auto-renewal; the seat remains usable until the end of the period already paid for, and then disappears. Fees already paid are not refunded on a pro-rata basis for the remainder of a period.

Failed payment. If a renewal payment fails, the affected licenses enter a grace period during which the Service continues to work. If payment is not recovered before the grace period ends, those licenses lapse and portal access is suspended until payment is brought current.

Taxes and purchase orders. Prices exclude applicable taxes. Public agencies may purchase by PO — contact [email protected]. Prices may change for future purchase and renewal terms; we will give notice before a change applies to your renewal.

5. Your data

You own your data. Runs, GPS traces, corridors, studies, reports, and everything derived from them remain the property of your organization. We claim no ownership.

You grant us only the limited licence needed to host, process, back up, and display that data in order to operate the Service for you. We do not sell it, do not use it for advertising, and do not use it to train third-party models. Handling is described in the Privacy Policy, which forms part of these Terms.

Export. You can export your data at any time in open formats (PDF, CSV, XLSX) while your organization is active.

6. Acceptable use

You agree not to:

  • Operate the mobile app in a way that is unsafe or unlawful. The app is designed for glanceable use by a driver; do not interact with the phone while the vehicle is in motion. You are solely responsible for safe and lawful operation of the vehicle.
  • Share seats between people, or circumvent seat limits, licence checks, or export watermarks.
  • Access data belonging to another organization, probe or scan the Service, or attempt to defeat its authentication or rate limits.
  • Resell, sublicense, or provide the Service to third parties as a bureau service, except that delivering study results and reports to your own clients is expressly permitted.
  • Upload unlawful content, or content you do not have the right to process.

7. Suspension, termination, and data retention

  • You may stop using the Service at any time and ask us to close your organization’s account.
  • We may suspend access for non-payment (§4) or for a material breach of §6. Where practical we will give notice and an opportunity to fix the problem first.
  • After an account closes we retain organization data for 30 days so it can be reinstated or exported, and then delete it. Ask before that window closes if you need a final export. Backups age out on their own retention schedule.

8. Availability and support

We aim to keep the Service available continuously, but it is provided without an uptime guarantee or a contractual SLA. Planned maintenance is announced to org admins by email where it is likely to be disruptive.

Support is by email at [email protected] during US business hours and is included in the annual fee.

9. Professional judgement — no warranty on results

ArterialPulse produces travel-time statistics, reliability metrics, platoon-arrival diagnostics, and economic-impact estimates from the data you collect and the assumptions you configure. These outputs are an engineering aid, not an engineering opinion.

Economic figures depend on assumption values (fuel price, value of time, occupancy, emission factors) that default to published national averages until your organization sets its own. Signal and cross-street names may be derived from third-party open map data. You are responsible for reviewing every result before relying on it, stamping it, or delivering it to a client or agency.

The Service is provided “as is”. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost or corrupted data arising from use of the Service.

Our total aggregate liability arising out of or relating to the Service is limited to the fees your organization paid us in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Third-party services

The Service uses third-party providers to operate — including Stripe (payments), Cloudflare (network and bot protection), Resend (transactional email), and OpenStreetMap-derived data (road and cross-street names). Their handling of data is described in the Privacy Policy. The mobile apps are distributed through the Apple App Store and Google Play, whose own terms apply to the download.

12. Changes to these Terms

We will publish a new “Last updated” date at the top of this page when these Terms change, and will notify organization administrators by email of material changes. Changes apply from the date they are posted; continuing to use the Service after that constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Kansas, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Kansas have exclusive jurisdiction, except that public-agency customers may substitute the governing law and venue required by their own procurement rules.
